AMY E MCCARTY, JD

Amy E. McCarty, JD, is a partner with Monahan Law Group, LLC.  Ms. McCarty concentrates her practice in probate litigation, including contested trust, estate, and guardianship litigation, mental health and confidentiality, juvenile court litigation, child welfare, and elder law.  She represents individuals, families, fiduciaries, such as guardians, trustees, executors, and agents under Powers of Attorney, financial institutions, medical institutions and child welfare institutions in all areas of her practice.  Ms. McCarty specializes in remedies to address abuse, neglect, and exploitation of the elderly and disabled.  She has litigated hundreds of contested guardianship matters and has been involved in numerous cases involving financial exploitation, which have resulted in significant financial recovery on behalf of the disabled adult.



Ms. McCarty is frequently consulted as an expert in mental health confidentiality issues and has participated in litigation involving novel and complex legal issues that concern the interplay between the Illinois Mental Health and Developmental Disabilities Confidentiality Act and other State and Federal statutes and regulations.  Prior to joining Monahan Law Group, she served for seven years as an assistant public guardian with the Cook County Public Guardian’s Office.  While there, Ms. McCarty served as the court-appointed guardian ad litem for abused, neglected, and dependent minors in the Child Protection Division of the Circuit Court of Cook County and subsequently managed the estates of disabled adults for whom the Public Guardian was appointed guardian.  She received her Juris Doctorate from The John Marshall Law School and was a visiting student at the Civitas ChildLaw Center and Clinic of Loyola University Chicago School of Law.
