Course Description:

As a mental health professional, you not only deal with critical clinical matters with your clients – you must also stay on top of seemingly ever-changing laws and procedures. Keeping up-to-date is essential in order to protect your clients and yourself. At this comprehensive one-day seminar, you will gain an understanding of involuntary commitment processes, guardianship and alternatives to guardianship, rights of individuals in institutions, privacy/confidentiality of mental health records and much more, that will help you stay on top of issues that arise in everyday clinical situations.

  1. Compare the processes for voluntary, involuntary and emergency admission for treatment.
  2. List at least three powers or duties of a guardian.
  3. Describe the exceptions to an individual’s right to refuse treatment.
  4. Define the duty to report abuse/neglect.
  5. Explain why and how psychotherapy notes are treated differently from medical records.
  6. Cite at least two differences between Texas privacy laws and HIPAA.


Amanda E. Love, Esq., is a staff attorney in the East Texas Regional Office of Disability Rights Texas, where she advocates on behalf of individuals with mental illnesses and intellectual disabilities. She received her BA in International Studies and Political Science from Emory University and graduated from Brooklyn Law School in 2008. Prior to joining Disability Rights Texas, Ms. Love spent five years in Louisiana as a public defender representing the criminally accused in state court and also worked as a civil rights attorney in the contest of employment and whistleblower matters.


The Honorable Tamorah Christine Butts, presides over Harris County Probate Court No. 4, where her docket is primarily guardianship and mental health cases. She is Board Certified in Estate Planning and Probate and practiced in those areas before her election to the bench. She was named in H Texas Magazine as a Top Lawyer for the People, 2006-2009 and as a Top Lawyer, 2007-2008; and was honored in Texas Monthly as a Super Lawyer Rising Star annually from 2008 to 2011. She earned her BBA at the University of Texas at Austin and her JD at the University of Texas at Houston.


Jeffery P. Drummond, Esquire, is a healthcare law partner in the Dallas office of Jackson Walker, LLP. His areas of expertise include representing hospitals and health systems, physicians and physician groups and other ancillary providers in transactional and regulatory matters. He advises clients regarding compliance with pharmaceutical, tax and health care laws and regulations, including medical record privacy and security, HIPAA, and cybersecurity issues. Mr. Drummond is a frequent speaker on those issues and mantains a blog on HIPAA matters at Mr. Drummond is also an adjunct professor of Healthcare Law and Policy at The University of Texas at Dallas.
